Peers secure climate and nature duties for the water industry

The dire state of our water has become a topic of household conversation and deep reforms are needed โ€“ but this week, pending the results of the newly established Water Commission, P4P Peers helped secure some positive improvements via the Water (Special Measures) Bill.


๐ŸŒŠ ๐—ข๐—ณ๐˜„๐—ฎ๐˜ ๐˜„๐—ถ๐—น๐—น ๐—ป๐—ผ๐˜„ ๐—ต๐—ฎ๐˜ƒ๐—ฒ ๐—ฎ l๐—ฒ๐—ด๐—ฎ๐—น โ€˜๐—ต๐—ฎ๐˜ƒ๐—ฒ ๐—ฟ๐—ฒ๐—ด๐—ฎ๐—ฟ๐—ฑโ€™ ๐—ฑ๐˜‚๐˜๐˜† ๐˜๐—ผ ๐—ฐ๐—ผ๐—ป๐˜๐—ฟ๐—ถ๐—ฏ๐˜‚๐˜๐—ฒ ๐˜๐—ผ ๐—ฐ๐—น๐—ถ๐—บ๐—ฎ๐˜๐—ฒ ๐—ฎ๐—ป๐—ฑ ๐—ป๐—ฎ๐˜๐˜‚๐—ฟ๐—ฒ ๐˜๐—ฎ๐—ฟ๐—ด๐—ฒ๐˜๐˜€, meaning that it'll need to consider how its own actions, and by extension those of water and sewerage companies, can contribute to our legally binding net zero and environmental targets. This is a significant improvement which will apply industry wide. (NB other regulators/public bodies need this).


๐ŸŒฑThereโ€™s been ๐—ฎ ๐˜„๐—ถ๐—ป ๐—ณ๐—ผ๐—ฟ ๐—ป๐—ฎ๐˜๐˜‚๐—ฟ๐—ฒ-๐—ฏ๐—ฎ๐˜€๐—ฒ๐—ฑ ๐˜€๐—ผ๐—น๐˜‚๐˜๐—ถ๐—ผ๐—ป๐˜€, as water companies will have to consider using NBS approaches in their drainage and sewerage management plans, which should improve progress towards our biodiversity targets and mean less concrete is deployed, and ๐—ฎ ๐—น๐—ผ๐—ผ๐—ฝ๐—ต๐—ผ๐—น๐—ฒ ๐˜๐—ต๐—ฎ๐˜ ๐—ฒ๐˜…๐—ฐ๐—น๐˜‚๐—ฑ๐—ฒ๐—ฑ ๐˜€๐—ผ๐—บ๐—ฒ ๐˜„๐—ฎ๐˜๐—ฒ๐—ฟ ๐—ฐ๐—ผ๐—บ๐—ฝ๐—ฎ๐—ป๐—ถ๐—ฒ๐˜€ ๐—ณ๐—ฟ๐—ผ๐—บ ๐˜€๐˜‚๐—ฏ๐—บ๐—ถ๐˜๐˜๐—ถ๐—ป๐—ด ๐—ฝ๐—ผ๐—น๐—น๐˜‚๐˜๐—ถ๐—ผ๐—ป ๐—ถ๐—ป๐—ฐ๐—ถ๐—ฑ๐—ฒ๐—ป๐˜ ๐—ฟ๐—ฒ๐—ฑ๐˜‚๐—ฐ๐˜๐—ถ๐—ผ๐—ป ๐—ฝ๐—น๐—ฎ๐—ป๐˜€ ๐—ต๐—ฎ๐˜€ ๐—ฏ๐—ฒ๐—ฒ๐—ป ๐—ฐ๐—น๐—ผ๐˜€๐—ฒ๐—ฑ.


Other reforms didnโ€™t make it through:ย 


๐Ÿ’ท Peers wanted the Water Restoration Fund on a legal footing and to make sure that fines paid by water companies for polluting are channelled into projects that fix the damage theyโ€™ve caused. Despite this being the stated purpose of the Fund, around 20% of fines in 2022/23 didnโ€™t make it into the fund โ€“ reflecting the usual reluctance of HM Treasury to ringfence funds.ย 


๐Ÿ“– Peers also pushed for sewerage companies to be fully transparent, and to proactively publish the environmental data they hold, which despite a court ruling and statements from the Information Commissioner and Ofwat that they must publish, some continue to withhold. Peers also made the case for existing provisions for โ€˜special administrationโ€™ โ€“ when a water company becomes insolvent or fails in its statutory duties or license conditions โ€“ to be used as the ultimate sanction for polluting companies.


So now itโ€™s over to MPs to go into bat as the Bill moves to the Commons.
